Terms of Service
These Terms of Service govern your access to and use of the CoachWorker platform and associated services provided by CoachWorker. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.
1. The service
CoachWorker provides cloud based operational management software for coach hire companies. Features available depend on the subscription plan selected. We reserve the right to modify, update or discontinue any part of the service with reasonable notice where a change materially reduces functionality.
2. Accounts
You must provide accurate and complete information when creating an account and keep it up to date. You are responsible for maintaining the security of your credentials and for all activity under your account. Notify us immediately at [email protected] if you become aware of any unauthorised access.
3. Acceptable use
You agree not to use the service for any unlawful purpose; attempt to gain unauthorised access to any part of the platform or its infrastructure; introduce viruses or harmful code; reverse engineer or decompile the software; resell or sublicense access without prior written consent; or process personal data without a lawful basis under applicable data protection law. We reserve the right to suspend accounts found in breach without prior notice.
4. Subscriptions and payment
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. Fees are exclusive of VAT where applicable and are non-refundable except as required by law or expressly agreed in writing. We reserve the right to suspend access if payment is overdue by more than seven days following notification.
5. Free trials and demos
Trial access is provided without warranty of any kind. We may modify or discontinue a trial at any time. Conversion to a paid subscription does not occur automatically.
6. Your data
You retain full ownership of all data you upload, create or store within the service. You grant CoachWorker a limited licence to process that data solely for the purpose of providing and improving the service. We act as a data processor in respect of any personal data contained within it. On termination you may export your data within 30 days, after which it may be permanently deleted.
7. Intellectual property
The service, including its software, interface, branding and documentation, is owned by or licensed to CoachWorker. Nothing in these terms transfers any intellectual property rights to you beyond the limited right to use the service during your subscription.
8. Confidentiality
Each party agrees to hold the other’s confidential information in confidence and not to disclose it to any third party without prior written consent, except as required by law. This obligation survives termination.
9. Warranties
We will provide the service with reasonable skill and care. We do not warrant that it will be uninterrupted or error free at all times. Except as expressly stated, the service is provided on an as is basis.
10. Limitation of liability
Neither party shall be liable for indirect, consequential, special or incidental loss or damage. Our total aggregate liability shall not exceed the fees paid by you in the twelve months preceding the event giving rise to the claim. Nothing limits liability for death or personal injury caused by negligence, fraud, or liability that cannot be excluded by English law.
11. Termination
Either party may terminate at the end of the current billing period by written notice before renewal. We may suspend or terminate immediately for material breach, non-payment after notice, or where required by law. On termination your access ceases immediately, subject to your data export rights.
12. Changes
We will give at least 30 days notice of material changes by email or in-platform notification. Continued use after the effective date constitutes acceptance.
13. Governing law
These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales. Contact: [email protected]
